Financial disputes can place immediate pressure on cash flow and commercial relationships. Mediation gives creditors, debtors, guarantors and advisers an organised setting in which to examine the figures, the disputed issues and realistic implementation options.
Issues that may be addressed
- Contested invoices or commercial debts
- Loan, security or guarantee disputes
- Repayment terms and cash-flow constraints
- Disagreement about interest, charges or accounting
- Multi-party contribution or allocation issues
A fact-based discussion
Preparation may include a clear statement of the sums claimed, relevant agreements, payment history and current financial information. The mediator helps the parties identify areas of agreement and disagreement without making a ruling on the debt.
Practical options
Where appropriate, parties may consider staged payments, revised dates, security, mutual releases, verification arrangements or other terms that reflect commercial reality. Availability and suitability depend on the particular facts.
Financial and legal advice
Participants should assess affordability, tax, insolvency, enforcement and documentation issues with their own advisers. A mediated proposal does not become a settlement unless the parties choose to agree and document it.
